Terms of Service – C. Victory Books

Welcome to C. Victory Books! These Terms of Service ("Terms") govern your access to and use of our website, QR checkout system, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services. These Terms form a legally binding contract between you and C. Victory Books ("we," "us," or "our").

You must be at least 18 years old or have the consent of a parent or legal guardian to use the Services. By using the Services, you represent that you meet these requirements.

1. Acceptance of Terms

By using the Services, you confirm that you have read, understood, and agree to these Terms, our Return Policy, and our Privacy Policy (incorporated herein by reference). We may update these Terms at any time by posting the revised version on our website. Continued use of the Services after changes constitutes acceptance. It is your responsibility to review these Terms periodically.

2. Use of Service

• You agree to use the Services only for lawful purposes and in compliance with all applicable local, provincial, federal, and international laws, including Canadian consumer protection laws.
• Provide accurate, current, and complete information during registration, checkout, or any interactions with us.
• Do not use the Services for any illegal, harmful, or unauthorized activities, including but not limited to: transmitting viruses, malware, or harmful code; engaging in harassment, defamation, or discrimination; or attempting to interfere with the Services' functionality.
• No automated access: You may not use robots, spiders, scrapers, or other automated means to access the Services without our express written permission.
• We reserve the right to suspend or terminate your access to the Services at our sole discretion, without notice, for any reason, including suspected violations of these Terms.

3. Purchases and Payments

• All prices are in CAD and are subject to change without notice. Prices do not include applicable taxes, which will be added at checkout.
• Payments are processed securely via Stripe. By providing payment information, you authorize us to charge your payment method for the total amount due.
• We reserve the right to refuse, cancel, or limit any order for any reason, including pricing errors, stock availability, or suspected fraud. You will be notified if an order is canceled.
• For returns, refunds, and eligibility, please refer to our Return Policy.
• You are responsible for ensuring that your payment method has sufficient funds and is valid. We are not liable for any fees charged by your financial institution.

4. Pickup and Delivery

• Purchases via the QR checkout system are for instant in-store pickup only at our location: 13624 108 Ave, Unit A, Surrey, BC V3T 2K5.
• You have a 21-day pickup window from the date of purchase to claim your items. Bring your pickup code (from your receipt email) and photo ID.
• Store hours: Mon-Fri: 10:00AM-07:30PM, Sat-Sun: 10:00AM-07:30PM. We are not responsible for delays due to store closures or unforeseen circumstances.
• After 21 days, unclaimed items will be restocked, and no refunds or exchanges will be issued, except as required by law.
• Risk of loss transfers to you upon pickup. We are not liable for items left unclaimed or lost after handover.

5. Intellectual Property

All content on the Services, including text, graphics, logos, images, book descriptions, and software ("Content"), is the property of C. Victory Books or our licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

• You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Content for personal, non-commercial purposes only.
• You may not copy, reproduce, distribute, modify, create derivative works from, or commercially exploit any Content without our prior written consent.
• Any unauthorized use may violate copyright, trademark, and other laws, and could result in legal action.
• We respect the intellectual property rights of others. If you believe your rights have been infringed, contact us at writing4thekids@victorycbooks.com.

6. User Content

If the Services allow you to upload, post, or submit content (e.g., reviews or feedback), you grant us a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and distribute such content for any purpose, including promotional use.

• You represent that your content does not infringe third-party rights and complies with these Terms.
• We are not responsible for user content and may remove it at our discretion without notice.

7. Third-Party Links and Services

The Services may contain links to third-party websites or services (e.g., Stripe for payments). These links are provided for convenience only, and we do not endorse or control them. We are not responsible for the content, privacy practices, or availability of third-party sites. Use them at your own risk and review their terms and policies.

8. Disclaimer of Warranties

The Services and Content are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or free from viruses or harmful code.

9. Limitation of Liability

To the fullest extent permitted by law, C. Victory Books, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability for death, personal injury, fraud, or any liability that cannot be excluded by law under British Columbia or Canadian regulations.

10. Indemnification

You agree to indemnify, defend, and hold harmless C. Victory Books and its affiliates from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, violation of these Terms, or infringement of third-party rights.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts of British Columbia.

We encourage informal resolution. If a dispute arises, contact us at writing4thekids@victorycbooks.com before pursuing legal action. You agree to submit to the personal jurisdiction of the courts in British Columbia.

12. Privacy

Your use of the Services is also governed by our Privacy Policy, which complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and British Columbia's Personal Information Protection Act (PIPA). We collect and use your personal information as described therein.

13. Miscellaneous

• Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force.
• Entire Agreement: These Terms, together with our Return Policy and Privacy Policy, constitute the entire agreement between you and us.
• No Waiver: Our failure to enforce any right does not constitute a waiver of that right.
• Assignment: We may assign these Terms without your consent; you may not assign them without our written consent.
• Force Majeure: We are not liable for delays or failures due to events beyond our control, such as natural disasters, strikes, or government actions.
